1. Scope
1.1 These General Terms and Conditions in the version valid at the time of the order exclusively apply to the business relationship between AVYNESS (a trade name of SevenT8Artists UG (haftungsbeschränkt)), Stammestraße 19, 30459 Hannover (hereinafter referred to as “Seller”) and the customer (hereinafter referred to as “Customer”).
1.2 A consumer, within the meaning of these terms, is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
1.3 Deviating terms and conditions of the customer shall not apply unless the Seller expressly agrees to their validity.
2. Offers and Service Descriptions
2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. Product descriptions in catalogs or on the Seller’s websites are not legally binding guarantees.
2.2 All offers are valid “while supplies last,” unless stated otherwise. Errors excepted.
3. Ordering Process and Contract Conclusion
3.1 The Customer may select products from the Seller’s range and collect them in a shopping cart using the “Add to Cart” button. Products can be changed or removed in the cart. The customer can then proceed to checkout using the “Proceed to Checkout” button.
3.2 By clicking the “Place Order and Pay” button, the Customer submits a binding purchase offer. Before submitting the order, the Customer can review and edit the data at any time or cancel the process. Required fields are marked with an asterisk (*).
3.3 The Seller sends an automatic order confirmation email listing the order details. This email serves only as confirmation of receipt and does not constitute acceptance of the offer. The purchase agreement is concluded only when the Seller ships the product within 2–4 days or confirms shipping with a second email, explicit order confirmation, or invoice. Acceptance may also occur through a payment request or successful payment. The earliest acceptance counts. If the offer is not accepted within the acceptance period, the contract is void.
3.4 For business customers, the acceptance period is extended to 7–10 days.
3.5 If prepayment is offered, the contract is concluded upon notification of payment details. If payment is not received within 10 days, the Seller may cancel the order. No delivery obligation arises, and the order becomes void.
4. Prices and Shipping Costs
4.1 All prices include applicable VAT.
4.2 Shipping is free within Germany unless otherwise stated.

Shipping costs are calculated and shown at checkout.

Orders may be delivered in parts if items come from different warehouses.

Freight deliveries are to the curbside. Delivery to the home is possible on request for a fee.

Insurance or special handling for art, vintage items, etc., is extra.
5. Delivery and Product Availability
5.1 For prepayment, delivery occurs after receipt of payment.
5.2 If delivery fails after three attempts due to Customer’s fault, the Seller may cancel the contract and refund the payment minus any incurred shipping/return costs.
5.3 If the Seller is not supplied by their supplier without fault, the Seller may cancel the contract and will inform the Customer and offer an alternative product if available.
5.4 Delivery timeframes and restrictions are provided in product descriptions or via email.
5.5 Risk passes to business customers when the goods are handed to the carrier.
5.6 The Seller is not liable for delivery delays due to force majeure or unforeseen circumstances affecting the Seller or suppliers.
5.7 Delivery within Germany usually takes 5–14 business days unless stated otherwise.
5.8 No deliveries are made on Sundays or public holidays.
6. Payment Terms
6.1 Customers can choose from available payment methods displayed during checkout.
6.2 Invoice payments must be made in advance.
6.3 When using third-party payment providers like PayPal or Klarna, their terms apply.
6.4 If payment is not made by the due date, statutory interest will apply.
6.5 Further damage claims are not excluded by late payment charges.
6.6 Offsetting is only permitted with legally established or recognized claims. Withholding rights apply only to the same contractual relationship.
7. Retention of Title
Goods remain the Seller’s property until fully paid.
For business customers:

Retention extends to all claims from the business relationship.

Buyer must handle goods carefully, insure them, and carry out maintenance at their cost.

If goods are processed with other items, the Seller gains co-ownership.

Claims from resale are assigned to the Seller as security.

The Seller may revoke collection rights if the customer defaults.

The Seller releases securities on request if their value exceeds the secured claims by more than 10%.
8. Customer Account
8.1 Customers can create an account with order and data access. Data is not public.
8.2 Guest checkout is possible.
8.3 Customers must provide accurate and up-to-date information.
8.4 Use of the account must follow legal and Seller terms. External software use (e.g. bots) is prohibited.
8.5 Customers are responsible for uploaded content. The Seller may take action if legal violations occur (e.g. delete content, issue warnings, or block access).
8.6 Customers may cancel their account at any time. The Seller may do so with reasonable notice (typically 2 weeks).
8.7 Upon cancellation, access to the account and data is removed. Customers are responsible for saving their data beforehand.
9. Warranty and Guarantee
9.1 Warranty is based on legal provisions.
9.2 Guarantees apply only if explicitly stated and shown before purchase.
9.3 Business customers must inspect goods and report defects within two weeks.
9.4 For business customers, the Seller decides between replacement or repair.
9.5 Warranty for business customers expires one year after delivery. Used goods are excluded from warranty.
9.6 The Seller is not obliged to reimburse installation/removal costs unless explicitly agreed.
10. Right of Withdrawal and Returns
You may withdraw from the contract within 14 days without giving a reason.

Return the goods within 14 days from notifying us.
Customers pay return shipping unless the item was faulty or incorrect. Plants are non-returnable.
Some returns may need to be sent to a different address depending on the supplier. We will notify you.
Return conditions:

Items must be undamaged and in original packaging.

All product parts must be unopened.

Refunds are made after inspection via the original payment method.

Damaged or mishandled items may be refunded only partially.
For damaged goods, please send a description and photos.
11. Liability
11.1 The Seller’s liability for damages is limited as follows:
11.2 Unlimited liability for intent or gross negligence.
11.3 For minor negligence, liability is limited to breach of essential contractual duties and foreseeable damage.
11.4 These limits do not apply to personal injury or product liability.
11.5 These rules also apply to employees, agents, and contractors.
12. Contract Text Storage
12.1 The Customer may print the contract before submitting the order.
12.2 The Seller sends an email confirmation with all order data.
12.3 Business customers may receive contract documents by email or link.
13. Final Provisions
13.1 For business customers, place of performance and jurisdiction is the Seller’s location, unless legally required otherwise.
13.2 German law applies excluding the UN Convention on Contracts for the International Sale of Goods.
13.3 Contract language is German.

We do not participate in dispute resolution proceedings before a consumer arbitration board.
